This Public Clarification clarifies the eligibility of goods for the VAT Profit Margin Scheme. It establishes a critical condition: only goods that have previously been subject to VAT within the UAE can be sold under this scheme. This rule specifically impacts second-hand goods, antiques, and collectors' items. Consequently, stock on hand acquired before the implementation of UAE VAT, or goods otherwise not subjected to VAT on a prior supply, are ineligible. For such items, VAT must be calculated on the full selling price. The guidance is based on Article 29(2) of Cabinet Decision No. 52 of 2017.
